Divisional Court Upholds York Region Development Plan

Ontario’s Divisional Court recently upheld an Ontario Municipal Board decision approving official plan amendments proposed by the Township of King and the Regional Municipality of York. These amendments collectively provide a plan for growth in the King City area to 2021 and also allow for servicing from the Region of York through the York-Durham sanitary servicing system.

Representing the Region of York were Jim Harbell of Stikeman Elliott and Manuela Di Re, the region’s in-house counsel. Tom Lederer and Chris Barnett of Davis & Company, acted for a group of private landowners, and Richard Storrey and Julie Rosenthal of Goodmans LLP represented the Ontario Municipal Board. The appellants consisted of a number of citizen groups represented by Elizabeth Christie and Robert Wright of the Sierra Legal Defence Fund. The respondent, Township of King, was represented by David Estrin of Gowling Lafleur Henderson LLP
