Doctor's Appeal Dismissed in Obstetrical Malpractice Case

On January 24, 2005, the Ontario Court of Appeal dismissed an appeal by obstetrician, Dr. George Sloan, in a medical malpractice case. The Court upheld the decision of Justice Granger, who found the doctor negligent in his use of forceps in delivering the respondent, Donna Knight's second child and in suturing Ms. Knight's injuries. At trial, Justice Granger awarded damages to the family from St. Thomas, Ontario.

Paul Bates of Cassels Brock & Blackwell LLP and David Williams of Harrison Pensa LLP represented the respondents on the appeal. David Hamer and Troy Lehman of McCarthy Tétrault LLP acted for the appellant.
