Sale of Montreal’s Complexe du Fort

On July 16, 2001, 9105-0476 Quebec Inc. bought the Complexe du Fort property, at the corner of Ste-Catherine and du Fort Streets in Montreal, from SB Montreal Loan Company for $37.15 million, putting an end to litigation that had continued for some time. This real estate is one of the more complicated properties in the city, as part of it is subject to divided ownership (condominium) and another part is subject to two layers of emphyteusis. This purchase was financed in part by a consortium consisting of The Canada Life Assurance Company, Clarica Life Insurance Company and Laurentian Bank of Canada, and in part by RoyNat Capital Inc.
Fraser Milner Casgrain LLP in Montreal acted for the purchasers. Luc Giroux headed up the litigation team, while Robert Carswell, Louise Houle, Véronique Théorêt and Pierre Setlakwe handled the real estate and financing site. Jean-François Fournier (business) headed the McCarthy Tétrault LLP team, assisted by Jean-François Boisvenu, Danielle Drolet, Caroline Fontaine and Marc Dorion, Q.C. Notary Pierre Lapointe represented RoyNat. The vendors were represented by Peter Kalichman of Irving, Mitchell & Associates (litigation), and by Anna Maria Masciotra, Kathryn Mason, Q.C. and Jenny Ross of Coudert Brothers (real estate).
