Confédération des Caisses populaires Desjardins (Desjardins) has been successful in defending a motion for declaratory judgment brought by Caisse Populaire de Trois-Pistoles which sought the annulment of the restructuring process engaged by Mouvement Desjardins, one of the most important financial institutions in the Province of Quebec.
On May 29, 2000, Justice Claude Larouche of the Superior Court of Quebec dismissed the motion, confirming the legality of the legal framework of the merger of Desjardins with the eleven federations of Mouvement Desjardins. This decision is of great consequence because it removes the last obstacle to the ongoing restructuring process aimed at improving Mouvement Desjardins’ competitiveness in the global market of financial institutions.
Alain Riendeau and Marianne Messier of the Montreal office of Fasken Martineau DuMoulin LLP pleaded the case on behalf of Desjardins. Appearing on behalf of the plaintiffs were Gervais Turbide of Turbide & Pellerin in Amqui, Quebec and Roger David, Montreal. |
