Kirk is a senior partner with 40 years of civil litigation experience. He regularly represents insurers/insureds regarding sophisticated, leading-edge coverage issues, including cyber risk, commercial property and general liability, D&O and E&O liability, builders risk and other specialty policies. He also represents insurers/insureds in complex tort and contractual litigation involving public entity defence, Charter claims, professional negligence, products liability, motor vehicle accidents, property damage, E&O, D&O, and occupiers’ liability. Kirk has extensive trial and appellate experience, appearing before all levels of the courts in Ontario, as well as the SCC. He has significant experience in the defence of complex multi-party class actions, commercial insurance arbitrations and mediation. In 2023 he successfully represented a major Canadian insurer in the national class action with respect to COVID-related business interruption losses. Kirk is a Senior Fellow of the Litigation Counsel of America, and certified as a Specialist in Civil Litigation by the LSO. He is consistently recognized as a leading practitioner in insurance litigation by notable peer and client rated directories. In 2018 he was the recipient of the OBA Award for Excellence in Insurance Law.
