Michael is a litigation partner in McCarthy Tétrault LLP’s Toronto office and Vice-Chair of the National Class Actions Group. His practice focuses on class actions and complex commercial and constitutional disputes. Representing both defendants and plaintiffs, Michael has litigated class actions at trial and at all levels of court, including the Supreme Court of Canada. He has also taught class actions as an Adjunct Professor at the University of Toronto Faculty of Law for a decade, and he is co-author of a text on the subject. Michael led the firm’s team representing the Canadian Civil Liberties Association in its successful challenge to the constitutionality of prolonged solitary confinement in Canadian prisons. Michael also led class actions on behalf of First Nations asserting a right to safe drinking water on their reserves. The resulting settlement, worth at least $8 billion, is one of the largest in Canadian history. Hailed by the courts as a “hopeful turning point,” it provides both compensation and infrastructure. Prior to joining the firm, Michael served as a law clerk to the Rt. Hon. Beverley McLachlin, Chief Justice of Canada. He is called to the Bars of Ontario and New York and holds an AB (Harvard, High Hons), MPhil (Cambridge, Distinction), and JD (Toronto, Hons).
