Patrice Benoit is a partner in Gowling WLG's Montréal office. Specializing in corporate restructuring, insolvency and commercial litigation, he is a member of the Corporate Restructuring National Practice Group. Patrice works primarily in all insolvency-related fields, whether on corporate restructuring and corporate reorganizations under the Bankruptcy and Insolvency Act or the Companies' Creditors Arrangement Act, on the realization of security or other forms of liquidation of assets. He regularly appears before the Superior Court of Québec (Civil and Commercial Chambers) and the Court of Appeal of Québec. Patrice notably led the insolvency counsel to MMA in connection with its restructuring process under the CCAA related to the July 2013 derailment in the city of Lac-Mégantic, which resulted in the deaths of 49 people and in damages of various natures suffered by approximately 5,000 creditors. This matter has been described by many commentators as one of the most complex restructuring process to take place in recent years. This multi-jurisdictional and cross-border matter led to the creation of an Indemnification Fund of half a billion dollars for the benefit of the victims of this tragedy. Patrice is often called upon to speak on banking law and insolvency related matters.
