Ben Bathgate is a partner in the firm's Litigation Group and co-Chair of the Fraud Law Group and White Collar Defence and Government Investigations Group. His practice focuses on complex corporate and commercial litigation in several specialized areas, including: commercial fraud, transactional disputes, professional liability (D&O claims) and franchise disputes. Ben is a trusted advisor to leading Canadian and international companies, managing large national teams in highly complex multi-party litigation. He has played a lead role in many high profile fraud and conspiracy proceedings in Canada, including as a partner on the Sino-Forest defence team in the Ontario securities fraud proceeding – the OSC’s largest hearing of this type since Bre-X Minerals, lasting 180 hearing days and relating to $3 billion in capital. Ben is a co-editor and co-author of "The Essential Guide to Settlement in Canada" (published in 2013 by LexisNexis Butterworths Canada), an authoritative text exclusively on the topic of settlement in Canada. He also co-founded McMillan’s Crisis Response Service, where teams of specialists in six areas of emergency legal services craft tailored business solutions for clients facing urgent and highly sensitive legal problems.
