Brian Daley is a partner at Norton Rose Fulbright in Canada. He practises in all areas of intellectual property law, with a focus on patents, trademarks, and litigation at the trial, appellate, and Supreme Court level. He is highly skilled in regulatory matters and litigation involving pharmaceutical, medical device, telecommunications, and mechanical patents. He is often retained to act as lead counsel on complex patent litigation in English and French. This includes traditional patent infringement actions, as well as those under Canada's Patented Medicines (Notice of Compliance) Regulations. He has successfully defended damages claims brought by generic pharmaceutical companies who claim to have been kept off the market because of proceedings brought by patentees. He has recently become involved in arbitration in the pharmaceutical field. He works pro bono for organizations helping refugees and the unhoused. He presents frequently to professional organizations and companies, and publishes in the intellectual property and regulatory fields in North America and Europe. He was called to the Quebec bar in 1994. He is a member of the Intellectual Property Institute of Canada and the American Intellectual Property Law Association.
