Neil Abbott is a partner in Gowling WLG’s Toronto office. A Certified Specialist in Construction Law (LSO), Neil is routinely ranked in both The Best Lawyers in Canada and The Canadian Legal Lexpert® Directory. He founded the firm’s Construction and Engineering practice and leads both the Municipal, University, School, and Hospital (MUSH) and the firm’s India practices. As a solicitor, Neil drafts contracts including CCDC, CCA, OCA, AIA, and tenders, and provides advice in terminations, completion contracts, and bond and delay claims for owners, contractors, lenders, municipalities, and universities in Canada and abroad, especially for US clients. He also now advises on COVID-19 excusable and delay claims, force majeure events, and compliance with Emergency Decrees. As a litigator, Neil has argued in courts, tribunals, arbitrations, and mediations in Ontario, BC, Alberta, Saskatchewan, and Nunavut and the Supreme Court. Neil prosecutes lien, bond, and trust claims, including receiverships, as well as enforced contract and New Home warranty and deficiency claims. He has acted in disputes among joint venture partners in infrastructure projects, and tender and expropriation claims. Neil has extensive familiarity with solar, wind, and alternate energy, as well as geotechnical issues.
