On August 23, 1999, R. Gordon Marantz, Q. C. , John MacDonald, Tracy Sandler and Rupert Chartrand of Osler, Hoskin & Harcourt appeared as counsel for The T. Eaton Company Limited (“Eaton’s”) before the Honourable Mr. Justice Farley sitting on the Commercial List seeking an Order appointing Richter & Partners Inc. as Interim Receiver over certain of the assets, excluding real estate and leasehold interests, of the company. In addition, Court approval was secured for an Agency Agreement authorizing the liquidation of inventory at the company’s 64 retail stores.
Richter & Partners Inc. was appointed as Interim Receiver and Trustee to preserve the company’s assets while Eaton’s management continues negotiations with prospective store purchasers. Acting for Richter are Ronald Robertson, Q. C. , Jonathan Levin and Edmond Lamek of Fasken Campbell Godfrey. Other counsel appearing included Jay Swartz of Davies, Ward & Beck on behalf of Retail Financing Inc. and Jay A. Carfagnini, Benjamin Zarnett and Robert Chadwick of Goodman Phillips & Vineberg on behalf of Cadillac Fairview Corporation. Bruce Leonard of Cassels, Brock & Blackwell is representing a group of major unsecured creditors.
