Class Action Against Lawyer

Delgrosso v. Jeffery Paul is said to be the first class action in Canada certified against a lawyer. The plaintiff represents a group of over 100 persons who invested their RRSP savings in self-directed mortgage investments through a financial advisor. The financial advisor is alleged to have directed the investors’ funds through various trust companies which retained a single lawyer. The litigation raises a number of novel issues including whether, on the facts of this case, a duty of care was owed by the defendant to the class.
