Quebec Pension Surplus Litigation

Montreal’s Desjardins Ducharme Stein Monast has been retained by Hydro-Quebec to represent the hydro-electric giant in class action proceedings commenced by the Association provinciale des retraités d’Hydro-Québec regarding the disputed use of surplus pension plan funds. The claim involves more than 8,000 retirees and beneficiaries. Although this case is currently the only such matter before the courts in Quebec, it is being closely watched and may trigger further litigation. An Alliance of retiree associations has recently been established in Quebec for purposes of ensuring the protection of the rights of retirees respecting private pension plans including promotion of an active involvement in the management of plan assets. The Alliance is presently comprised of three associations which have, collectively, approximately 27,000 members.
