Duke Energy Sells Pipeline Interest

Duke Energy sold its 23.6 per cent interest in the Alliance Pipeline, Aux Sable and related assets to Enbridge Inc. and Fort Chicago Energy Partners LP for approximately US$245 million. The deal closed on April 1, 2003.

Enbridge was represented in-house by Darby Wade, vice-president and general counsel, and Tom Schwartz, associate general counsel; and working under their direction was McCarthy Tétrault LLP with a team that included Michael Bennett (corporate) and Yves Bériault and Dominic Thérien (competition). Bennett Jones LLP represented Fort Chicago, with a team that included Renée Ratke, Don Anderson and Colin Perry (corporate) and Cam Chiasson (competition).

Alliance was represented by general counsel Warren Wismer and senior counsel Carmen Marshall, and Aux Sable was also represented by in-house counsel Katherine Dodds and Craig Allen, and working under their direction was Glenn Hardie (corporate) of Fraser Milner Casgrain LLP.

Duke Energy was represented by in-house counsel Curt Bernardi, and working under his direction was Torys LLP with a team that included Phil Symmonds, Sharon Pel and Aaron Emes (corporate), Jay Holsten (competition), Chris Fowles (derivatives) and Jim Welkoff (tax).
