Certified Specialist in Civil Litigation (LSO) since 1993. Served as General Counsel (ON) for CN. Rejoined private practice in January 1998, solo from 2009. Ken’s active advocacy and counsel has continued especially as to transportation law & dispute resolution in railway regulatory matters, crossings & rights of way issues, and injury, commercial and shipping cases. Expertise in drafting, negotiation and interpretation of agreements in the rail sector, in dealing with rail operators, industry & municipalities, and federal and provincial regulatory & licensing agencies in the transportation field. Assists clients with resolving employment disputes or grievances & remedies, and handling coroners' inquests. Has addressed Indigenous (First Nations) law issues: claims, surrender and treaty rights, and consultation issues (in relation to both railway and non-railway operations/lands). Appeared in various arbitration and mediation proceedings and all levels of the courts—including the Supreme Court, Federal Court of Appeal & Courts of Appeal (ON & SK).
