Michael Burgar is a trial and appeal lawyer who has worked on thousands of litigation cases over 32 years. Michael has successfully conducted jury and non-jury trials, motions, applications, and appeals. Most of his current caseload relates to tort and insurance law cases. Michael also conducts significant commercial and construction litigation matters. Recent notable cases include: (1) White Point Capital Inc. v. Communitylend Holdings Inc. and FinanceIt Canada Inc., 2022 ONSC 5146, for the plaintiffs (a financial advisory firm and the advisor). The claim was settled after one day of discovery of the defendant's CEO for the amount sought in the statement of claim, plus costs ($2.9 million all-inclusive); (2) Stewart v. Demme, 2022 ONSC 1790 (Div Ct), 2020 ONSC 83, a successful defence appeal and decertification of a class action on behalf of a hospital nurse sued for intrusion upon seclusion (invasion of privacy). Ten individual actions against the nurse were later dismissed; and, (3) Gallagher v. Todish, 2023 ONSC 4894, a successful summary judgment motion on behalf of an auto insurer upholding the termination of an auto policy.
