First Quantum Minerals Settles DRC Mining Disputes

First Quantum Minerals (FQM), Eurasian Natural Resources Corp. PLC (ENRC) and the Democratic Republic of the Congo (DRC) agreed to settle all outstanding disputes related to three mining properties in the DRC as part of a sale by FQM to ENRC of its interest in the properties and certain other assets in the DRC for a purchase price of US$1.25-billion.

Fasken Martineau DuMoulin LLP represented FQM in its two bilingual international arbitrations against the DRC (one under the ICC Rules and the other under ICSID). Additionally, the firm assisted in companion litigation brought in the British Virgin Islands.

Fasken Martineau also advised on the M&A deal which concluded those and related disputes with the DRC and ENRC, and provided advice on Canadian and international government relations and strategic communications.

The litigation team was led by Geoffrey Cowper, QC, and assisted by Dominique Gibbens, René Cadieux and Philippe Charest-Beaudry in Montréal, Keri Gammon in Toronto, Colin Edstrom in Vancouver, and Robert Paydon in London.
