The Kilmer Group Joins OMERS and CPP Investment Board

On December 4, 2002, the Kilmer Group, the private investment holding entity of Lawrence M. Tanenbaum, joined OMERS and Canada Pension Plan Investment Board (CPP Investment Board) as a shareholder of Borealis Capital Corporation. The value of the deal is undisclosed. Borealis is an independent manager of alternative capital assets, and currently has more than $9 billion of private equity, real estate and infrastructure assets under management.

In connection with the acquisition, Tanenbaum has been appointed a director and vice-chairman of Borealis, and Dale Lastman of Goodmans LLP was appointed a director.

Kilmer was represented by Goodmans, with a team led by Dale Lastman and including David Matlow, Mark Surchin and Mark Spiro. Borealis was represented by Gowling Lafleur Henderson LLP, with a team led by Christopher Bardsley and including Tina Woodside and Paul Holden. OMERS was represented by Nicholas Dietrich of Gowling Lafleur Henderson. CPP Investment Board was represented by Philip Mohtadi of Torys LLP.
