The firm’s clients include both producers and users of technology, as well as other legal, financial and technical professionals who provide products and services to the information technology industry.

Intellectual Property: (Contacts: Gervas Wall, Patents and Copyright; Marijo Coates, Gary Daniel, Trade-marks) The firm advises clients on clearance, protection and enforcement of patents, trade-marks, copyright, industrial designs, trade secrets and use of regulatory processes to derive optimal benefits from their intellectual property. The firm advises in the negotiation of all forms of agreements to commercialize intellectual property, including licences, acquisitions, franchises and joint ventures.

PROFILES

Richard Austin: Richard’s areas of practice include outsourcing, development and systems implementation, privacy and security including the EU’s new General Data Protection Regulation, IT governance and regulatory compliance, licensing and Canada’s anti-spam legislation. Before joining DWW, Richard was general counsel of EDS Canada, one of Canada’s largest information technology service providers, for 18 years. Richard is a former Director and President of the Canadian IT Law Association and a member of the Executive Education Faculty of the Centre for Outsourcing Research and Education (CORE). He is a frequent speaker on technology law issues including on outsourcing, IT governance, privacy, cloud computing, social media, Canada’s Anti-Spam Legislation and Identity Management. Richard was called to the Ontario Bar in 1985.

Marijo Coates: Marijo's expertise includes advising on commercial transactions involving IP licensing, merchandising, distribution and supply agreements. Marijo handles the IP portfolios of clients in Canada and abroad, including the prosecution and enforcement of the clients’ IP rights. The businesses range from cosmetics and food to the automotive industry, chemicals and software technology. Marijo is active in the CBA, IPIC, INTA, and MARQUES. Marijo has written and spoken on various aspects of trademark law and edited texts on Canadian trademark practice and procedure. She is the author of Register Your Trademark in Canada, published by International Self-Counsel Press. She was called to the Ontario Bar in 1983 and the Nova Scotia Bar in 1986. She is a Registered Trademark Agent.

Gary Daniel: Gary practises intellectual property law, including trademark, copyright and trade secrets and related litigation. His practice extends from the prosecution of trademark applications through to litigation of intellectual property rights.  He appears in the courts of the Province of Ontario, as well as the Federal Court of Canada and before the Trademark Opposition Board and he advises clients in complex licensing issues and has acted as intellectual property counsel in major corporate transactions. Gary has been recognized by numerous publications, including: Chambers Canada, Chambers Global, The Best Lawyers in Canada, The Legal 500 Canada, Who's Who Legal, World Intellectual Property Review and World Trademark Review.  Gary is involved in charitable organizations and for many years sat on the National Board of Directors of Special Olympics Canada where he continues to serve as Ombudsperson. He was call to the Ontario Bar in 1989.

Douglas N. Deeth: Recognized in international reviews, including The Lexpert®/American Lawyer Guide to the Leading 500 Lawyers in Canada, as one of Canada’s Leading Intellectual Property and IP Litigation lawyers. Practice combines extensive litigation experience with expertise product acquisition and licensing, particularly in the pharmaceutical area. Served as a Director of a number of start-up pharma companies. Advises clients on clearance, protection and enforcement of intellectual property rights; appears before the Federal Court and the Ontario courts. President of FICPI, the International Federation of Intellectual Property Attorneys, and former President of FICPI’s Communications Commission. Former member of the executive of the CBA(O) intellectual property section; past president of FICPI Canada; member of the IPIC, AIPLA, AIPPI and FICPI. Has lectured on IP issues at McGill, McMaster and University of Toronto, and spoken at national and international meetings on current IP issues. Graduate of U of Waterloo (engineering) and U of Toronto (law). Called to the Ontario Bar (1976) and is a Registered Patent and Trademark Agent.

Gervas W. Wall: Gervas’s practice extends from the prosecution of patent and trade-mark applications to intellectual property litigation. He appears in the courts of the Province of Ontario, the Federal Court of Canada and before the Trade-marks Opposition Board and Patent Appeal Board. Gervas has over 30 years of experience in litigation in intellectual property and information technology, including trials and injunctions. He advises on complex licensing issues and has acted as special intellectual property counsel in major corporate transactions and to international organizations. Gervas is a fellow of the IPIC and teaches the annual patent agent tutorials. Gervas writes and speaks regularly on intellectual property matters, including patent protection, licensing and security interests in intellectual property. He was called to the Ontario Bar in 1981 and is a Registered Patent and Trademark Agent.

Amy-Lynne Williams: Amy-Lynne practises exclusively in the area of information technology law and advises on outsourcing, electronic payments, privacy, e-commerce and Internet issues, international and domestic agreements for systems, and technology transfers. She is listed in The Best Lawyers in Canada, as well as Expert Guides “Best of the Best”. Ranked in Band 1 of Chambers and Partners Canada Guide – Information Technology Lawyers and a “leading individual” under IT in Chambers Global: The World’s Leading Lawyers for Business.
