Funds Invest in HOCHTIEF AirPort Capital

On March 1, 2005, two funds managed by Hasting Funds Management Ltd. (Australia), Caisse de dépôt et placement du Québec (Canada) and KfW IPEX-Bank (Germany) completed an investment in a newly founded partnership, HOCHTIEF AirPort Capital KGaA (HTAC), into which HOCHTIEF AirPort has contributed about a third of its participations in Athens, Düsseldorf and Hamburg airports and 49 per cent of its participation in Sydney Airport. The transaction has a volume of approximately ? 343 million—over C$540 million.

HOCHTIEF Airport was represented in-house by Hartmut Paulsen and Nadine Bussler, and by Freshfields Bruckhaus Deringer with a team led by Dr. Ludwig Leyendecker and Dr. Kai Hasselbach (M&A) that included Dr. Franz Aleth (corporate), Andreas Roehling and Dr. Christian Vollrath (antitrust), and Dr. Alexander Goertz, Johannes Wirtz, Dr. Beatrice Hartmann and Daniel Schmedding (corporate).

Caisse de dépôt et placement du Québec was represented by Robert Côté, director, legal affairs, and McCarthy Tétrault LLP with a team led by Marc Dorion, Q.C., that included Kim Thomassin (business – infrastructure), Claude Desaulniers (taxation) and Yves Comtois (competition). The Caisse was also represented by Taylor Wessing, for German law issues and due diligence, with a team composed of Dr. Rudiger von Hulst, Dr. Achim Glade, Eva-Maria Beutler, Isabel Rauch and Stefan Kimmel (corporate) and Dr. Markus Wirtz (antitrust).
